1. Acceptance of Terms
These Terms of Service ("Terms") form a legally binding agreement between you ("User", "you") and CampaignMind Ltd ("CampaignMind", "we", "us") governing your access to and use of the CampaignMind platform, APIs, mobile applications, and related services (collectively, the "Service").
By creating an account, clicking "Start free", or otherwise accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are accepting on behalf of an organisation, you represent that you have authority to bind that organisation.
If you do not agree to these Terms, do not use the Service.
2. Description of Service
CampaignMind is an AI-powered marketing platform that enables users to create, schedule, publish, and analyse social media campaigns across multiple platforms. Key features include:
- AI-driven campaign strategy, copywriting, and creative briefing
- Multi-channel scheduling and publishing to connected social platforms
- Performance analytics, audience insights, and automated reporting
- Brand memory and voice-learning for consistent on-brand outputs
- Team collaboration with role-based access controls
- Smart Inbox for unified social media engagement management
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Account Registration
You must create an account to use CampaignMind. When registering you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Keep your password confidential and use a strong, unique password
- Notify us immediately of any unauthorised access to your account
- Accept responsibility for all activity that occurs under your account
You must be at least 16 years old to create an account. Accounts registered by bots or automated methods are not permitted.
4. Acceptable Use
You agree to use CampaignMind only for lawful purposes and in accordance with these Terms. You must not use the Service to:
- Generate, publish, or distribute content that is unlawful, defamatory, harassing, abusive, fraudulent, or obscene
- Violate any applicable laws or regulations, including data protection, advertising standards, or platform terms of the connected social networks
- Infringe any third-party intellectual property, privacy, or other rights
- Publish misleading or deceptive content, including AI-generated content without appropriate disclosure where required by law or platform policy
- Conduct spam campaigns, send unsolicited messages, or manipulate social media metrics artificially
- Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure
- Reverse-engineer, decompile, or attempt to extract the source code of any part of the Service
- Use the Service in a way that imposes an unreasonable load on our infrastructure
- Resell, sublicence, or provide access to the Service to third parties without our written consent
Violation of this section may result in immediate suspension or termination of your account without refund.
5. AI-Generated Content
You own what you create. Content you produce using CampaignMind — including AI-generated drafts you approve and publish — is owned by you, subject to the licences below.
Review before publishing. AI-generated content may occasionally be inaccurate, incomplete, or unsuitable. You are solely responsible for reviewing, editing, and approving all content before it is published to any platform.
Compliance is your responsibility. You are responsible for ensuring that all content you publish via CampaignMind complies with applicable laws (including advertising regulations, FTC guidelines, ASA standards, and GDPR), as well as the terms of each social platform you publish to.
No guarantee of results. CampaignMind does not guarantee the effectiveness, reach, or commercial performance of any campaign or content generated through the Service.
You grant CampaignMind a limited, non-exclusive licence to process, store, and transmit your content solely to provide and improve the Service as described in our Privacy Policy.
6. Intellectual Property
CampaignMind IP. The Service, including its software, algorithms, UI, branding, and documentation, is owned by CampaignMind Ltd and protected by copyright, trade mark, and other intellectual property laws. Nothing in these Terms transfers ownership of CampaignMind IP to you.
Your IP. You retain ownership of your brand assets, copy, images, and other materials you upload to the Service. You grant us a limited licence to use such materials solely to provide the Service.
Feedback. If you provide suggestions, bug reports, or ideas about the Service, you grant CampaignMind a royalty-free, perpetual licence to use that feedback without restriction or compensation.
7. Subscriptions & Billing
CampaignMind is offered on a subscription basis. By subscribing you agree to the following:
- Billing cycle — Subscriptions are billed monthly or annually in advance, depending on the plan you choose. Annual plans are billed as a single upfront charge.
- Automatic renewal — Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date.
- Price changes — We may change pricing with at least 30 days' notice. If you do not agree to the new price, you may cancel before the change takes effect.
- Refunds — Monthly subscriptions are non-refundable. Annual subscriptions may be refunded on a pro-rata basis within 14 days of purchase if you have not used the Service substantially.
- Taxes — Prices are exclusive of applicable taxes (VAT, GST, sales tax). Taxes are calculated and shown at checkout based on your billing address.
- Failed payments — If a payment fails, we will retry over 7 days. Continued failure may result in service suspension until payment is resolved.
To cancel, go to Settings → Billing in the product. Cancellation takes effect at the end of the current billing period.
8. Free Trial
We may offer a free trial of paid features for a limited period. The following conditions apply:
- One free trial per individual or organisation.
- No payment method is required during the trial unless you choose to upgrade.
- At the end of the trial, access to paid features will be restricted unless you subscribe.
- We reserve the right to modify or discontinue trial offers at any time.
9. Confidentiality
Both parties may have access to confidential information of the other party. Each party agrees to keep such information confidential and not to disclose it to third parties without prior written consent, except as required by law or as necessary to provide the Service.
Your brand strategies, campaign briefs, customer data, and unpublished content are treated as your confidential information. We will not access your content except to provide the Service, debug issues with your authorisation, or as required by law.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
We do not warrant that:
- The Service will meet your specific requirements or achieve any particular marketing results
- AI-generated content will be accurate, complete, lawful, or suitable for publication
- The Service will be available at any particular time or without interruption
- Any errors or defects will be corrected
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAMPAIGNMIND AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR THE SERVICE.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD 100.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY. IN SUCH CASES, OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
12. Indemnification
You agree to indemnify, defend, and hold harmless CampaignMind and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of the Service in violation of these Terms
- Content you create, upload, or publish through the Service
- Your violation of any applicable law or third-party rights
13. Termination
By you. You may close your account at any time from Settings → Account. Closing your account cancels any active subscription at the end of the current billing period.
By us. We may suspend or terminate your access immediately and without notice if we believe you have violated these Terms, are engaged in fraudulent activity, or pose a security risk. We may also terminate for convenience with 30 days' written notice.
Effect of termination. Upon termination, your right to access the Service ends. We will delete your data as described in our Privacy Policy. Sections 6 (Intellectual Property), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), and 14 (Governing Law) survive termination.
14. Governing Law
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer located in the European Union, you may also benefit from mandatory provisions of the law of the country in which you are resident.
15. Changes to Terms
We may revise these Terms from time to time. When we make material changes, we will notify you by email at least 14 days before the new Terms take effect. We will also display a notice in the product.
If you continue to use the Service after the effective date, you accept the updated Terms. If you do not agree, you may close your account before the changes take effect.
